Terms of Use

Gifft.me lets people create, send, and open virtual gifts. Please use the Services responsibly, do not submit unlawful or harmful content, and do not copy or extract our original animations and assets.

Agreement

These Terms of Use ("Terms") govern your use of the gifft.me website and related products and services (collectively, the "Services"). The Terms are an agreement between you and gifftme ("gifftme", "we", "us", or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old to create an account or submit personal information through the Services. If applicable law in your location requires a higher age for you to consent to these Terms or the processing of your personal information, you must meet that higher age or have permission from a parent or legal guardian. The Services are not directed to children under 13.

Accounts

You are responsible for maintaining the security of your account and for activity performed through it. You must provide accurate information and notify us at info@gifft.me if you believe your account has been used without authorization. We may restrict or terminate accounts involved in fraud, spam, abuse, illegal activity, security violations, or repeated violations of these Terms.

User content

You retain ownership of messages, images, audio, comments, and other content you submit ("User Content"). You grant us a limited, worldwide license to host, store, copy, process, transmit, format, display, and deliver User Content only as needed to operate, secure, moderate, and improve the Services. This license ends when the content is deleted from our active systems, subject to reasonable backup, legal, fraud-prevention, and security retention.

You are responsible for your User Content and must have the rights necessary to submit it. You may not submit content that is unlawful, infringing, fraudulent, defamatory, threatening, abusive, sexually exploitative, invasive of another person's privacy, malicious, or designed to facilitate spam or harm. We may use automated moderation and may refuse, restrict, or remove content that violates these Terms or creates risk for users or the Services.

Gift links are designed to be shared. Anyone who receives or discovers a gift link may be able to access the gift, so do not include sensitive information that should remain private.

Premium Gifts and payments

Premium Gift purchases are one-time purchases of digital functionality. They are not physical goods, subscriptions, stored-value accounts, or currency, and they do not automatically renew. Depending on the checkout shown to you, a purchase may upgrade a specific gift or add a stated number of Premium Gift credits to your account. One credit is consumed when it is successfully applied to a gift. Credits are personal, non-transferable, have no cash value, and may not be resold.

Prices, pack sizes, promotions, and taxes are displayed at checkout and may change for future purchases. Payments are processed by Stripe and are subject to its applicable terms. Digital purchases are generally final once delivered. If a duplicate charge or verified technical failure prevents delivery, contact info@gifft.me with your purchase details so we can investigate and, where appropriate, restore credits or issue a refund. Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

We may suspend fulfillment or access when a payment is reversed, charged back, fraudulent, unauthorized, or made in violation of these Terms. We may correct a credit balance that resulted from an error or duplicate fulfillment.

Our content and intellectual property

Except for User Content and identified third-party materials, the Services and their original animations, audiovisual sequences, illustrations, graphics, three-dimensional models, textures, sounds, interface elements, text, software, and other assets are owned by or licensed to gifftme and are protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use those materials only through the Services for their intended purpose. You may not extract, copy, reproduce, modify, distribute, sell, sublicense, publicly display, reverse engineer, scrape, or use them to create another product or service except where applicable law expressly permits it. No ownership rights are transferred to you.

YouTube and third-party services

Some features use YouTube API Services to search for, select, and play YouTube videos. By using those features, you agree to the YouTube Terms of Service. The Services may also contain advertisements or links to third-party services. Your interactions with those third parties are governed by their terms and policies, and we are not responsible for their products or conduct.

Prohibited uses

You may not use the Services to:

break the law or infringe another person's rights;
harass, threaten, impersonate, defraud, or harm another person;
send spam, phishing messages, malware, or other harmful code;
scrape, crawl, automate access to, or overload the Services without permission;
bypass security, moderation, rate limits, access controls, or payment controls; or
reverse engineer the Services except where that restriction is prohibited by law.

Availability and warranties

The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted operation, permanent storage, compatibility with every device, or that every error will be corrected. Keep your own copy of important User Content.

Limitation of liability

To the fullest extent permitted by applicable law, gifftme and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the Services. Our aggregate liability relating to the Services will not exceed the greater of one US dollar or the amount you paid to gifftme during the one month preceding the event giving rise to the claim. These limitations do not apply where prohibited by law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold gifftme and its affiliates, officers, employees, agents, suppliers, and licensors harmless from third-party claims and reasonable costs arising from your User Content, your violation of these Terms, or your willful misuse of the Services.

Governing law and disputes

These Terms and disputes arising from them are governed by the applicable laws of the United States, without regard to conflict-of-law principles. Any mandatory consumer protections and jurisdiction rights available in your place of residence remain unaffected. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Changes

We may update these Terms from time to time. We will revise the date below and provide additional notice when required by law. Your continued use of the Services after updated Terms become effective means you accept them.
